This website is operated by Japan Essence e.U. The terms “we", “us" and “our" refer to Japan Essence. Japan Essence offers this website, including all information, tools and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Section 1 – Online Store Terms

By using this website, you represent that you are at least the age of majority in your state or country of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this website.

You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws).

A breach of any of these terms will result in immediate termination of the services.

Section 2 – General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer over networks.

Section 3 – Accuracy of Information

We are not responsible if information made available on this website is not accurate, complete or current. Reliance on any material on this website is at your own risk.

Section 4 – Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the service at any time without notice to you.

Section 5 – Products or Services

Certain products or services are available exclusively online. These products or services may have limited quantities and are subject to our withdrawal and returns policy (see the “Right of Withdrawal & Returns" page).

All prices in our online store include statutory value-added tax (currently 20 %) and are subject to shipping costs unless stated otherwise. VAT is shown separately on the order summary and the invoice.

Section 6 – Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal of 14 days for contracts concluded at a distance. The full withdrawal instructions, including the conditions, deadlines and procedure as well as the model withdrawal form, can be found on our page “Right of Withdrawal & Returns" (https://japan-essence.com/policies/refund-policy).

You can also declare your withdrawal using the withdrawal function provided on our website.

In addition to the statutory right of withdrawal, we voluntarily grant an extended return period of 30 days in total; details can also be found on the page mentioned above.

Section 7 – Accuracy of Billing and Account Information

We reserve the right to refuse or cancel orders. You agree to provide current, complete and accurate information for all purchases.

Section 8 – Third-Party Tools

We may provide you with access to third-party tools or features over which we neither monitor nor have any control. They are provided to you “as is" and “as available" without any warranties, representations or conditions of any kind. Use of these tools is at your own risk, and it is your responsibility to review and accept the relevant third-party terms of use.

Section 9 – Third-Party Links

We are not responsible for the content or accuracy of materials provided by third parties. Complaints or questions regarding third-party products should be directed to those third parties.

Section 10 – Comments and Feedback

You agree that we may edit and use any comments you submit to us without restriction. We assume no responsibility for content posted by users.

The submission of personal data is governed by our Privacy Policy, which is available on the website.

Section 12 – Errors and Inaccuracies

We reserve the right to correct any errors or inaccuracies on our website and to change information without prior notice.

Section 13 – Prohibited Use

You may not use the website for any illegal or unauthorised purpose. Violations may result in immediate termination of your use.

Section 14 – Liability

We are liable without limitation for damages arising from injury to life, body or health, as well as for damages based on an intentional or grossly negligent breach of duty on our part. In the case of slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical of the contract. Any further liability is excluded. Mandatory statutory provisions, in particular under product liability law, as well as your statutory warranty rights, remain unaffected.

Section 15 – Severability

If any provision of these Terms is found to be invalid, the validity of the remaining provisions remains unaffected.

Section 16 – Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr. We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.
